Terms & Conditions

1. BOOKING & PAYMENTS

A booking deposit is required to confirm sessions booked more than 30 days in advance. For sessions within 30 days, full payment is due at booking. No photography will take place, and no rights are granted until payment is made in full.

2. REFUNDS & CANCELLATIONS

All deposits and payments are non-refundable for cancellations, no-shows, late arrivals preventing the shoot, or cancellations less than 1 hour before the session.

Exceptions: With proper notice, refunds will be issued for medical emergencies, flight delays, death in the family, or severe weather. If insufficient notice is given, only 50% may be refunded. Costs for props, rentals, clothing, or permits remain the client’s responsibility.

3. PHOTOGRAPHY PACKAGES & DELIVERABLES

Packages include a limited number of edited high-resolution images. Not all images will be delivered. RAW files are not provided. Clients receive a watermarked gallery for selections, with chosen images delivered without watermark. Extra images may be purchased individually or as a Buyout package. Retouching (skin edits, object removal, etc.) is available for an additional fee.

4. LIMIT OF LIABILITY

This contract is the full agreement between 808 Pictures and the Client. 808 Pictures is the exclusive photographer for the session. In case of illness or emergency, a qualified substitute may be provided. If services cannot be performed due to illness, accident, disaster, strike, or other causes beyond control, liability is limited to a refund.

Photographers are not responsible for client appearance (blinking, wardrobe issues, etc.) or environmental conditions (lighting, weather, crowds). Unsafe or unlawful photo requests may be refused.

5. WEATHER & INCLEMENT CONDITIONS

Sessions proceed in light rain or passing showers unless unsafe. If storms prevent shooting, the photographer may relocate or reschedule. If already onsite and rain prevents shooting, sessions may continue under umbrellas or be shortened. Refunds are considered case by case.

6. SHOOTING TIME & COOPERATION

Sessions begin at the scheduled time. Late arrivals shorten the session and may reduce images delivered. Clients are expected to cooperate fully. No other professional photographers may shoot during the contracted session unless approved by 808 Pictures.

7. LOCATIONS & SITE RULES

808 Pictures may recommend locations, but the final choice is the Client’s responsibility. Clients must secure any necessary permits. 808 Pictures is not liable for injuries, accidents, or damages during sessions. Clients participate at their own risk.

8. COPYRIGHT & USAGE RIGHTS

All images remain the copyright of 808 Pictures. Clients are granted personal-use rights, including printing and social media sharing. Images may not be resold or used commercially without written consent.

808 Pictures reserves the right to use images for marketing, portfolio, and publication unless the Client opts out in writing before the session.

9. DELIVERY TIMELINE

Edited images are delivered in 2–3 weeks in JPG format only. No reshoots will be provided except for proven technical failure.

10. FILE STORAGE & ARCHIVING

Clients should download and back up images immediately. 808 Pictures archives files for 60 days after delivery, after which files may be deleted. The studio is not liable for loss due to corruption, disasters, or failures after delivery.

11. MODEL & MEDIA RELEASE

Client grants 808 Pictures irrevocable permission to use images or video for editorial, promotional, advertising, or artistic purposes in any media. Names may be revealed unless anonymity is requested in writing. Clients waive rights to compensation. Client use is limited to personal use only.

12. AGE & CONSENT CONFIRMATION

I affirm that I am of legal age to enter this agreement:

19 in Alabama, Nebraska, Wyoming 21 in Colorado, Mississippi, Pennsylvania, Puerto Rico 18 in all other U.S. states and Canada

I am over 21, have read this consent and release (or had it explained in my native language), fully understand it, and enter voluntarily without coercion.

13. GOVERNING LAW

This agreement is governed by the laws of the State of Hawaii, with disputes resolved in Maui County, Hawaii.

We will be adding a mandatory location permit fee of $25.00 to each package, which will be sent to the DLNR for permission to use outdoor locations in Hawaii.
